This summary, based on his comments and observations, is appropriate for discussion and debate in the classroom setting.<\/p>\n<p>Summaries of important legal cases from 2005, as identified by the Honourable Mr. Justice Stephen Goudge of the Ontario Court of Appeal at OJEN&#8217;s 2005 Summer Law Institute.<\/p>\n<p>1.&nbsp;<a href=\"\/wp-content\/uploads\/Auton-v-AG-of-British-columbia-Aug-2009.pdf\" target=\"_blank\">Auton (Guardian ad litem of) v AG of British Columbia, [2004] 3 SCR 657, 2004 SCC 78<\/a><\/p>\n<p>This case raises the issue of whether the Province of British Columbia\u2019s refusal to fund a particular treatment for preschool-aged autistic children violates the right to equality under the Canadian Charter of Rights and Freedoms\u201d [para. 1].&nbsp;The full decision is available&nbsp;<a href=\"http:\/\/scc.lexum.org\/en\/2004\/2004scc78\/2004scc78.html\" target=\"_blank\">here.<\/a><\/p>\n<p>2. <a href=\"\/wp-content\/uploads\/Chaoulli-v-Quebec-Aug-2009.pdf\" target=\"_blank\">Chaoulli v Quebec (Attorney General), [2005] 1 SCR 791, 2005 SCC 35&nbsp;<\/a><\/p>\n<p>Does a prohibition against privately funded healthcare violate the Charter of Rights and Freedoms if the public health care system is not adequately treating citizens?&nbsp;The full decision is available <a href=\"http:\/\/scc.lexum.org\/en\/2005\/2005scc35\/2005scc35.html\" target=\"_blank\">here.&nbsp;<\/a><\/p>\n<p>3. <a href=\"\/wp-content\/uploads\/R-v.-Orbanski-Aug-2009.pdf\" target=\"_blank\">R v Orbanski, R v Elias, [2005] 2 SCR 3, 2005 SCC 37<\/a><\/p>\n<p>Limits on an individual\u2019s Charter right to counsel during a roadside alcohol-screening test.
