AB c Bragg Communications Inc.<\/em>, 2012 CSC 46, [2012] 2 RCS 567<\/h3>\nA.B., une mineure, a \u00e9t\u00e9 victime de cyberintimidation. Elle a d\u00e9couvert que quelqu\u2019un avait cr\u00e9\u00e9 un faux profil sur Facebook sous une version l\u00e9g\u00e8rement diff\u00e9rente de son nom. Sur ce faux profil, on y a fait des allusions quant au comportement sexuel d\u2019A.B. Elle a d\u00e9pos\u00e9 une requ\u00eate pour qu’on lui d\u00e9voile l’identit\u00e9 de la personne ou des personnes qui ont cr\u00e9\u00e9 ce faux profil et a demand\u00e9 au tribunal de l\u2019autoriser \u00e0 proc\u00e9der de fa\u00e7on anonyme en soutenant que, si son identit\u00e9 \u00e9tait rendue publique, elle courait le risque d\u2019\u00eatre victime d’intimidation de nouveau. Dans cette affaire, la Cour supr\u00eame du Canada (CSC) devait mettre en balance le droit \u00e0 la vie priv\u00e9e d’A.B. et l’int\u00e9r\u00eat du public, car, selon le principe de la publicit\u00e9 des d\u00e9bats judiciaires, ces derniers doivent \u00eatre transparents et accessibles au public.
